General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed between Sunny Bunny e.U. (trading as Babbily) and our customers via the online shop www.babbily.eu.
By placing an order, you agree to these Terms and Conditions.

If any individual provision of these GTC is found to be invalid in whole or in part under mandatory statutory provisions (in particular the Austrian Consumer Protection Act – KSchG), the remaining provisions shall remain unaffected.

2. Contracting Party and Conclusion of Contract

The purchase contract is concluded with:

By placing products in the online shop, we make a binding offer to conclude a contract for those items.
You can place products in the cart without obligation and review or correct your entries before submitting your binding order by using the editing tools provided during checkout.
The contract is concluded when you click the “Buy now” button to accept the offer for the goods contained in your shopping cart.
Immediately after placing your order, you will receive an automatic order confirmation by e-mail.

3. Contract Language and Storage

The contractual language is English (and German for the German-language version of the site).
We store the contract text on our internal systems; it is not accessible to you online after purchase. Order details are included in your confirmation e-mail.

4. Prices and Payment

1. Unless otherwise stated, all prices are gross prices including VAT, plus shipping costs shown during checkout.
   We reserve the right to adjust prices in line with supplier changes or market conditions.

2. Payments can be made by credit card, debit card, or other methods offered during checkout.
   Payment processing is handled securely through our partner Stripe Payments Europe Ltd. via Shopify Payments.
   Your payment data is processed exclusively by Stripe under strict PCI-DSS security standards.

5. Retention of Title

All goods remain the property of Sunny Bunny e.U. until full payment has been received.

6. Voluntary Return Guarantee

In addition to your statutory right of withdrawal, we offer a voluntary 30-day return guarantee:
Products may be returned within 30 days of receipt provided that

• they are complete, unused, and in their original condition, and

• all original labels are attached.

Products excluded from statutory withdrawal rights (e.g., customised items) cannot be returned under this guarantee.
This voluntary return guarantee does not limit your statutory rights.

7. Transport Damage

If goods are delivered with visible transport damage, please report such damage immediately to the delivery agent and contact us as soon as possible.
Failure to do so will not affect your legal rights or warranty claims but helps us assert claims against the carrier.

8. Warranty and Guarantees

Statutory warranty rights apply.
We guarantee that the goods at the time of delivery conform to the product descriptions on www.babbily.eu and are free from material defects.
Any additional manufacturer’s guarantees are stated in the respective product descriptions.

9. Liability

We are liable without limitation for damages caused by us, our legal representatives, or vicarious agents

• in the event of injury to life, body, or health,

• in cases of intent or gross negligence,

• where a guarantee has been given, and

• under the scope of the Austrian Product Liability Act.

In cases of minor negligence resulting in the breach of essential contractual obligations (cardinal duties), liability is limited to foreseeable, typical damages at the time of contract conclusion.
Further liability is excluded.

10. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
